Terms & Conditions

1. General Refund and Cancellation

(a) You may cancel your shipping order any time before submitting a signed order form without cost or cancellation fee. Once you’ve submitted your order and a deposit has been processed, your order is officially booked.

(b) If you’ve submitted a signed order form that has been officially booked and decide to cancel, a cancellation fee (100% of the total shipping cost) will be charged. We implement this fee to compensate for the resources utilized in initiating the job, including truck space, fuel, and any incurred “dead” mileage.

(c) All cancellations must be made via phone and email to our branch.

(d) Please note that Streaming Logistics reserves the right to cancel an order at any time.

2. Pickups and Deliveries

(a) Streaming Logistics cannot guarantee a specific driver/carrier.

(b) The driver/carrier cannot pick up or deliver a vehicle/shipment (with the exception of trailers) at residential locations due to commercial truck restrictions. The driver/carrier will pick up and deliver the vehicle/shipment at a nearby, ample, safe, and legally allowed commercial truck friendly location (such as Walmart, Target, Home Depot, Lowe’s, etc.) to load and unload vehicles/shipment.

(c) Port pickups and deliveries are subject to additional charges of $300 to $600 in certain ports. Customers must inform the transport agent if it is a port pickup or delivery order.

(d) Customers must assign someone on their behalf and notify Streaming Logistics of who that person will be in the event the customer is unavailable to release and/or accept vehicle/shipment delivery.

(e) In the event that a customer/assigned person is unable to release or accept a vehicle/shipment, the customer is liable for a rescheduling fee of $700, storage, plus a re-delivery fee.

3. Times and Dates

(a) Streaming Logistics provides approximate pickup and delivery updates. ETAs are approximate times/dates and serve as a general guide to the status of the customer’s vehicle/shipment.

(b) Streaming Logistics is not responsible for delays in transit due to truck mechanical issues, road conditions, weather conditions, or any other unforeseen delays, such as disease and virus outbreaks. There are no guarantees in relation to pickup and delivery times or scheduled dates.

(c) Streaming Logistics will not be responsible for any financial loss or damage due to delays of any cause. Additionally, Streaming Logistics is not responsible for any car rental costs or any other type of delay accommodations.

4.Vehicle/Shipment Preparation

(a) Customers are responsible for preparing the vehicle/shipment for transport. Any racks or luggage should be removed, otherwise specified by the transport agent. The vehicle must be in working/running condition unless noted on the shipping order form. Preferably, the vehicle should have less than 1/2 tank of gas, and ideally less than 1/4 tank of gas. If a vehicle/shipment is not ready for transport, customers acknowledge a $200/hr standby fee is applicable after 1 hour.

(b) Customers are liable for any damage or loss to an object or person caused by an attached or loose part of the vehicle/shipment.

(c) Streaming Logistics is not responsible for any mechanical issues or anything related to operating vehicle parts.

(d) Alarms must be disarmed or customers must provide instructions on how to disarm the alarm to the transport agent and the driver/carrier at pickup. The driver/carrier is authorized to disable/silence the alarm in the event the alarm goes off.

(e) If the vehicle/shipment is different than expected (number, dimensions, condition, etc.), the customer is liable for a rescheduling fee, cancellation fee, or rate adjustment.

5. Personal Items

(a) The Department of Transportation does not allow auto carriers to transport household goods (personal belongings) in vehicles being transported. An auto carrier will be fined, and your personal belongings can be impounded if they are pulled over for inspection.

(b) Streaming Logistics is not responsible for any loss of personal items in the vehicle or any damaged items due to the transportation of the vehicle.

(c) Customers are responsible for disabling or removing toll pass devices from vehicles. Streaming Logistics is not responsible for any toll charges due to toll pass devices left in vehicles.

(d) The driver/carrier can refuse to transport a vehicle/shipment with items that are considered unlawful contraband. Some illegal items include money, guns, ammunition, explosives, live pets, or any other related illegal items.

6. Inop/Non-Running Vehicles

(a) Inoperable or non-running vehicles are subject to additional fees. These fees can range from a minimum of $300 for small compact vehicles to up to $1000 for larger vehicles. If a rollback/tow is required, the customer is fully responsible for those fees. Please consult with the transport agent for the estimated charge.

(b) If the vehicle is inoperable before pickup or becomes inoperable while in transit and it is not noted on the shipping order form, the customer is fully responsible for the fees applicable to transport inoperable vehicles.

(c) Fees will be due at delivery to the carrier after the final inspection of the vehicle.

(d) Streaming Logistics is not responsible for any inoperable or non running fees in the event that vehicles become inoperable or non-running before pickup or while in transit.

7. Oversize and Modified Vehicles

(a) Customers must disclose/inform Streaming Logistics prior to the pickup of the vehicle/shipment about the following items: oversize vehicles, oversize wheels, lift kits, racks, limos, low clearance, or any simple modification on the vehicle/shipment for proper costs.

(b) In the event Streaming Logistics is not informed (prior to pickup) of any of the items mentioned above, the driver/carrier may refuse to transport the vehicle/shipment due to odd sized modifications that may damage the vehicle/shipment or risk cargo.

(c) If the driver/carrier does transport the vehicle/shipment, customers are responsible for all fees associated with the transport. Fees will be due at delivery to the driver/carrier.

(d) Streaming Logistics is not responsible for any oversize and modified associated fees.

8. Carrier Bill of Lading/Inspection Report

(a) The driver/carrier and customer are responsible for conducting a careful inspection of the vehicle/shipment and noting any pre-existing damage on the bill of lading/inspection report. Both the driver/carrier and customer must acknowledge the condition of the vehicle/shipment at both pickup and delivery locations.

(b) If the driver/carrier does not provide a bill of lading/inspection report, it is the customer’s sole responsibility to request a copy before pickup and delivery. The decision to ship the vehicle/shipment without a copy of the bill of lading/inspection report is at the customer’s discretion.

(c) The terms and conditions of the order are subject to the bill of lading/inspection report of the actual driver/carrier.

(d) The customer’s bill of lading/inspection report is provided by the driver’s/carrier’s office and is also provided to our office by the driver/carrier.

9. Vehicle/Shipment Damage

(a) In the event that any negligent damage occurs during shipping, customers should NOT sign or accept the vehicle/shipment. Streaming Logistics must be notified via phone before signing any paperwork or accepting the vehicle/shipment.

(b) It is the customer’s responsibility to inspect the vehicle/shipment in detail at both pickup and delivery. Any damage that can be directly linked to negligence by the assigned driver/carrier must be detailed on the bill of lading/inspection report and acknowledged by both the driver/carrier and the customer, regardless of weather conditions or time of day.

(c) A signed bill of lading/inspection report without any damage notations serves to verify that the customer and/or assigned person has received the vehicle/shipment in the same condition it was at the time of pickup, and that Streaming Logistics and its agents are relieved of any further responsibility.

(d) Customers should submit, in writing directly to the driver’s/carrier’s office, a detailed bill of lading/inspection report of any negligent damage attached with clear images/pictures of the damage and a couple of estimates within 5 days of accepting the vehicle/shipment to initiate any action on the issue. Streaming Logistics will support customers in good faith if an issue occurs.

(e) Streaming Logistics is not responsible in any way for any negligent damage caused by the assigned subcontract driver/carrier.

(f) Streaming Logistics is not responsible in any way for any claimed damage caused while the vehicle/shipment is under the control of a subcontract driver/carrier, regardless of whether the subcontract driver/carrier is at fault for the damage.

(g) Streaming Logistics is not responsible for any damages caused by acts of God, weather conditions, or broken parts of the vehicle/shipment due to worn parts of the vehicle/shipment.

(h) Any insurance verification methods employed by Streaming Logistics are strictly on a best-efforts basis and should not be solely relied upon by customers.

(i) If insurance coverage ($75,000 Open – $250,000 Enclosed) does not satisfy the customer’s expectations for coverage of the vehicle/shipment, Streaming Logistics suggests that customers seek and purchase their own additional cargo insurance coverage.

(j) A copy of the certificate of insurance is available upon customer request for review.

(k) Streaming Logistics is in no way responsible and/or liable for any damage claim denied by the subcontract driver/carrier insurer.

10. Form of Payment at Delivery

(a) Only cash or certified bank checks (made payable to the assigned driver/carrier) are acceptable for the remaining balance. Personal checks, money orders, debit or credit cards are not accepted at delivery. There are no exceptions. (b) If the remaining balance is not paid in the form of cash or certified bank check (made payable to the assigned driver/carrier), the customer acknowledges that the vehicle/shipment is subject to be placed in a storage facility.

(c) In the event that the customer is unable to pay the remaining balance in any of the forms mentioned above or is unable to accept the vehicle/shipment, the customer is responsible for storage fees and any re delivery fees.

11. Broker/Carrier

(a) Streaming Logistics is a registered, licensed, and bonded property broker and auto motor carrier (MC# 833646) with the U.S. Department of Transportation.

(b) Customers acknowledge that Streaming Logistics can, if needed, assign an order/contract to our licensed, bonded, and insured subcontract motor carriers to meet specific customer requests.

12. Claims

(a) Any disagreement, claim, or controversy arising from these terms and conditions, performance, or breach thereof shall be subject to the jurisdiction of Tampa County in Florida.

(b) Streaming Logistics and the customer acknowledge and agree to waive any right to the jurisdiction of this matter at any other location other than Tampa, Florida.

(c) Streaming Logistics is not responsible for claimed damage caused by subcontracted driver/carrier.

(d) Streaming Logistics can only be responsible for the deposit from the quote provided to the customer in the order.

Liability Disclaimer for Vehicle Transport

1. Damage incurred due to personal items left in the vehicle.

2. Damage to boots, caps, bras, or any other related covering canvas.

3. Damage to antennas, audio equipment, or phone equipment.

4. Damage to vinyl or cloth over 2 years old.

5. Damage to undercarriage, tie downs, brakes, exhaust system, suspension, wheel bearings or alignment. Streaming Logistics and the assigned driver/carrier are not responsible for any of these items, because no evaluation of such items is done during inspection.

6. Damage sourced to leaking fluids, in relation to brake fluid, transmission fluid, motor oil, steering fluid, and radiator coolant, or any other related leaking fluid not described in this section.

7. Damage to the battery or freezing cooling system.

8. Damage caused by a vehicle unable to load or unload off the carrier on its own power or loss of braking system.

9. Damage due to factory tie downs or frame tie downs through holes.

10.Damage due to acts of God.

11.Damage due to flying objects or the general sky, including rock chips or debris on the road.

12.Damage not noted at the pickup or delivery locations due to weather or poor lighting conditions.

Liability Disclaimer for RV and Trailer Transport

1. Customers must prepare and verify that the RV/trailer is roadworthy and ready for transport prior to pickup. This includes inspecting and/or replacing tires, wheels, bearings, braking system, electrical and disconnecting all utility lines. If an RV/trailer is not ready for transport, customers acknowledge that a $200/hr standby fee is applicable after 1 hour.

2. Sway bars/stabilizers are not provided as they are not absolutely necessary for towing unless the trailer is unstable behind the vehicle. The customer must provide their own sway bar/stabilizer if required.

3. Insurance does not cover damage caused by a tire blowout or any interior damages, including but not limited to fixtures, drawers, appliances, etc. If the RV being towed is at least 50 percent as heavy as the towing vehicle or the rear of the tow vehicle sags when the trailer is hooked up, a weight distribution system is recommended.

4. The driver/carrier may, in good faith and to the best of their ability, make an effort to resolve general or common trailer issues, such as replacing a tire or battery.

5. Any mechanical, electrical, flat or blown tires, including damage to the trailer and unforeseen costs resulting from the previously mentioned, will be the sole liability of the owner.

6. The driver/carrier will make every effort to accommodate the owner in contacting any roadside services if needed.

7. Should a mechanical, electrical or tire failure occur, the driver/carrier will move the unit to the safest location possible and contact the owner immediately.

8. In the event the RV/trailer becomes inoperable while in transit and requires repairs that will delay our transit time, the owner acknowledges that they are subject to a $400 daily fee to cover the driver’s salary, hotels, schedules, and other expenses.

9. The driver/carrier will pick up and deliver the trailer at a designated, ample, safe, and legally allowed location (RV park, storage space, legal driveway or street).

10.If the trailer is different than expected (number, dimensions, condition, etc.), the customer is liable for a rescheduling charge/fee, cancellation charge/fee, or rate adjustment.

11.If a customer’s order has been assigned to a driver/carrier, and the customer decides to cancel, a cancellation charge/fee (100% of the total shipping cost) will apply. The cancellation fee is implemented to compensate for the loss of reservation, fuel, and “dead” mileage driven.

12.Streaming Logistics is in no way responsible and/or liable for any damage claim denied by the subcontract driver/carrier insurer.

Liability Disclaimer for Driveaway Transport

1. Customers must prepare and verify that the vehicle is roadworthy and ready for transport prior to pickup. This includes inspecting and/or replacing mechanical parts, tires, wheels, bearings, braking systems, and electrical components. If a vehicle is not ready for transport, customers acknowledge that a $200/hr standby fee will apply after one hour.

2. The customer is responsible for ensuring that the vehicle has a full gas tank at the time of pickup. If the vehicle does not have a full gas tank, the customer will be responsible for the cost of fueling the vehicle to a full tank.

3. Insurance does not cover interior damages, including but not limited to personal items, fixtures, drawers, appliances, etc., while in transit.

4. The driver/carrier may, in good faith and to the best of their ability, make an effort to resolve general or common vehicle issues, such as replacing a tire or battery, adding general fluids, etc.

5. Any mechanical, electrical, flat or blown tires, including damage to the vehicle and unforeseen costs resulting from the previously mentioned issues, will be the sole liability of the owner.

6. The driver/carrier will make every effort to accommodate the owner in contacting any roadside services if needed.

7. Should a mechanical, electrical, or tire failure occur, the driver/carrier will move the unit to the safest possible location and contact the owner immediately.
